Book Summary:

The Land is the Source of Law brings an inter-jurisdictional dimension to the field of indigenous jurisprudence: comparing Indigenous legal regimes in New Zealand, the USA and Australia, it offers a ‘dialogical encounter with an Indigenous jurisprudence’ in which individuals are characterised by their rights and responsibilities into the Land. Though a relatively "new" field, indigenous jurisprudence is the product of the oldest continuous legal system in the world. Utilising a range of texts – films, novels, poetry, as well as "law stories" CF Black blends legality and narrative in order to redefine jurisprudentia in indigenous terms. This re-definition gives shape to the jurisprudential framework of the book: a shape that is not just abstract, but physical and metaphysical; a shape that is circular and concentric at the same time. The outer circle is the cosmology, so that the human never forgets that they are inside a universe – a universe that has a law. This law is found in the second circle which, whilst resembling the ancient Greek law of physis is a law based on relationship. This is a relationship that orders the placing of the individual in the innermost circle, and which structures their rights and responsibilities into the land. The jurisprudential texts which inform the theoretical framework of this book bring to our attention the urgent message that the Djang (primordial energy) is out of balance, and that the rebalancing of that Djang is up to the individual through their lawful behaviour, a behaviour which patterns them back into land. Thus, The Land is the Source of the Law concludes not only with a diagnosis of the cause of climate change, but a prescription which offers an alternative legal approach to global health.

Book Summary:

When it was first published in 1987, The Law of the Landreassessed the legal and political arguments traditionally used to justify European settlement of Australia. Henry Reynolds argued compellingly that the British government in fact conceded land rights to the Aborigines early in the nineteenth century. In rejecting the concept of terra nulliusin the historic Mabo case of 1992, the High Court of Australia effectively verified Henry Reynold's conclusions on the issue of native title. Now update to cover the Mabo judgement, the Wik decision of 1996 and subsequent developments, Reynold's remarkable and seminal work remains central to the race debate in Australia.

Book Summary:

This book is an examination of the law of land registration in England and Wales, in the light of the Land Registration Act 2002, and in particular at the way land registration is influenced by, and in turn influences, the evolution of land law as a whole. It examines the legal problems that have arisen in connection with land registration and considers the effect of the 2002 statute, drawing extensively upon the law in other jurisdictions and considering possibilities for future development. This is a book which will be essential reading for students, their teachers, and practitioners who will have to grapple with the intricacies of the new Act when it comes into force.

Holdsworth, Sir William. An Historical Introduction to the Land Law. London: Oxford University Press, 1927. xxiv, 339 pp. Reprinted 2004 by The Lawbook Exchange, Ltd. LCCN 2002025949. ISBN 1-58477-262-X. Cloth. $95. * Sir William Holdsworth [1871-1944] was one of the most distinguished historians of English common law. Written to provide students of Real Property with a concise history of the field, Holdsworth believed this knowledge necessary as contemporary land law was difficult to understand without an understanding of its roots. Fifoot commends this book in his English Law and its Background for its history of the rules against perpetuities (121). The Law Quarterly Review noted that "every beginner will certainly have to read [this] book before he reads anything else" (44:105). Both sources cited in Marke, A Catalogue of the Law Collection at New York University (1953) 773.
